If you are a parent of a child with disabilities & your in jail, can your mom get power of attorney w/out you?

If you have been convicted of fellony drug charges, and while in jail for 3 months, and there is no immediate concerns of child with learning disabilities, can your mom take over with a power of attorney without the person in jail having any knowledge of this. If so, when the person gets out of jail, can that power of attorney be removed, and how do you go about doing this. Parent is now a recovering addict and has 2 years clean and trying very hard to do the right thing and taking responsability for her own.

She could go to court and get guardianship. Or, the child protective agency could place the child with her. She could not get a “power of attorney,” because only you can grant that.
