What can I do if a District Attorney refuses to file rape charges involving my minor child?

My daughter was raped by two guys in February of 2008 and the District Attorney refuses to file charges against the individuals who did this.This District Attorney has a record for refusal to prosecute in that area even when it involves drug charges of minors.

      contact a judge and the Federal Marshal.

      If the DA is an elected official then he/she isn’t filing the charges because they don’t believe they could win the case in court. They only file charges that they think they can win. This way their statistics look good when it is time for re-election.
      If you are dealing with a lower deputy DA, then you may need more support from the police agency that investigated the case and a meeting with the boss of the DA that refuses to file the case.
      In any case, it sounds rather odd that they wouldn’t file. I can only speculate that there are problems with the evidence or statements that makes the DA believe a conviction couldn’t be won so it would be a waste of time and money to take it to court. Rape is dealt with pretty strongly just about everywhere now.

      Contact your state & Federal congressmen & tell them you need assistance in this matter.

      Ask for the appointment of a Special Prosecutor.
